By accessing or using any part of GetOfferInsight (the "Service"), whether as a home buyer, visitor, or licensed real estate agent ("Agent"), you agree to be legally bound by these Terms of Service and Privacy Policy (collectively, "Terms"). If you do not agree to all of these Terms, you must not use the Service.
If you are using the Service on behalf of a business or organization, you represent that you have authority to bind that entity and that you accept these Terms on its behalf.
Your acceptance is recorded electronically when you check the acceptance checkbox during account creation or first use. We store the timestamp of your acceptance for legal compliance purposes.
GetOfferInsight is a technology platform that generates AI-assisted market research summaries ("Reports") for residential properties in the United States. Reports are compiled from publicly available listing data, user-provided photographs, uploaded inspection documents, and third-party data sources including valuation APIs.
The Service also operates a paid advertising platform that allows licensed real estate agents to display their profiles to buyers researching properties in specified zip codes ("Agent Listings").
GetOfferInsight is not a real estate brokerage, a licensed mortgage lender, an attorney, a home inspector, a financial adviser, or an escrow company. The Service does not facilitate or participate in any real estate transaction.
All content generated by the Service — including Reports, photo observations, comparable sales data, and market commentary — is provided for educational and informational purposes only. Nothing in any Report or on any page of the Service constitutes:
You should consult appropriately licensed professionals — including a licensed real estate agent, real estate attorney, home inspector, mortgage lender, and financial adviser — before making any decision in connection with a real estate transaction. GetOfferInsight expressly disclaims all liability for decisions made in reliance on the content of any Report.
You must be at least 18 years of age and legally capable of entering a binding contract to use the Service. By using the Service you represent and warrant that you meet this requirement.
When you create an account you agree to provide accurate, current, and complete information and to keep your account credentials secure. You are solely responsible for all activity that occurs under your account. You must notify us immediately at the contact address in Section 21 if you suspect unauthorized access.
Agent profiles displayed in Reports are paid advertising placements, not endorsements, recommendations, or referrals by GetOfferInsight. Presence in a Report does not constitute a brokerage relationship of any kind. GetOfferInsight receives no referral fees, commissions, or compensation tied to any transaction.
Agents must hold and maintain a valid real estate license in good standing in each state for which they list coverage zip codes. You authorize GetOfferInsight to verify your license status with the relevant state licensing authority at any time.
Agents are responsible for ensuring that any buyer-facing profile content — including bio, claims of experience, and contact information — is accurate, does not violate applicable advertising or fair housing laws, and complies with the rules of the applicable Multiple Listing Service (MLS) and state real estate commission.
GetOfferInsight may suspend or remove an Agent profile at any time for violation of these Terms, misrepresentation, or conduct that the company reasonably determines is harmful to buyers or the platform, without liability and without refund of prepaid subscription fees.
Agent plans are billed monthly on a recurring basis via Stripe. Eligible new agents may receive a 30-day free trial; the trial is available once per license number. After the trial, your card is charged automatically at the then-current plan rate. You may cancel at any time from your dashboard; cancellation is effective at the end of the current billing period. No prorated refunds are issued for partial months.
Certain Report levels and photo analysis features require one-time purchases processed via Stripe. All sales are final. Refunds are issued solely at our discretion if a technical failure on our part prevented delivery of the purchased content.
We reserve the right to change subscription or feature prices with 30 days' written notice. Continued use after a price change constitutes acceptance of the new price.
Reports are generated using large language models (including Anthropic Claude) and automated data pipelines. AI-generated content may contain errors, omissions, hallucinations, or outdated information. GetOfferInsight does not warrant the accuracy, completeness, or timeliness of any Report.
Comparable sales data is sourced from third-party APIs and public records; it may not reflect all transactions or current market conditions. Comparable listings used in analysis may have different characteristics from the subject property. Any price ranges or cost estimates are illustrative only and not appraisals.
Photo observations are produced by AI vision models analyzing images you upload. These observations are meant to flag items for discussion with a licensed inspector — they are not a substitute for a professional home inspection and may miss defects that an in-person inspection would detect.

We share your information in the following circumstances:
We share data with vendors who perform services on our behalf — including Anthropic (AI inference), Stripe (payment processing), Resend (transactional email), RentCast (property data), HERE (geocoding), and our database and cloud infrastructure providers. These vendors are contractually bound to use your data only to perform services for us.
By using the Service, you grant GetOfferInsight a perpetual, worldwide, royalty-free license to use, reproduce, and distribute anonymized, aggregated data derived from your usage — including but not limited to: property addresses searched, zip codes of interest, Report sections accessed, photo analysis outcomes, and agent engagement signals — to compile market-trend reports, buyer demand indices, and related analytical products ("Market Insights"). Market Insights may be provided or sold to third parties, including real estate brokerages, title companies, mortgage lenders, institutional investors, market research firms, and property data aggregators.
Market Insights do not include your name, email address, precise device identifier, or any other information that directly identifies you as an individual. Before inclusion in any Market Insight product, data is aggregated across multiple users and locations such that no individual's activity is discernible.
When you click "Request introduction" for an Agent, we send that Agent your email address and the property address so they can contact you. This is a voluntary action initiated by you.
We may disclose your information if required by law, court order, or valid governmental request, or if we believe in good faith that disclosure is necessary to protect the rights, property, or safety of GetOfferInsight, our users, or the public.
In the event of a merger, acquisition, financing, or sale of all or a portion of our assets, user information may be transferred as part of that transaction. We will notify you by email or prominent notice on the Service before your data becomes subject to a materially different privacy policy.
We do not sell your name, email address, telephone number, or precise device identifier to third parties for their independent marketing use. The Market Insights described above are aggregated data products and are not sales of personal information under applicable privacy law definitions, except as noted in Section 11 for California residents.

You have the right to object to processing based on legitimate interests, to withdraw consent, and to lodge a complaint with your local supervisory authority.
Submit requests to privacy@getofferinsight.com. We will respond within 30 days (or 45 days where an extension is permitted by law). We may require identity verification before processing requests.
Photographs you upload are processed by AI vision models to generate observations for inclusion in your Report. By uploading photos you represent and warrant that you own or have the right to submit those images and that doing so does not infringe any third party's rights.
Uploaded photos are stored on our secure private cloud storage so that you can view them alongside the AI observations in your saved Report. Photos are retained for 12 months from the date of upload, after which they are permanently and automatically deleted. You may request earlier deletion at any time by emailing privacy@getofferinsight.com.
Photos are not used to train AI models without your separate, explicit consent. Access to stored photos is restricted to authenticated requests — photos are not publicly accessible.
You grant GetOfferInsight a limited license to store, process, and analyze uploaded images solely for the purpose of generating your requested Report and displaying those images within your Report for the duration of the retention period.

We do not currently use third-party advertising cookies or cross-site tracking pixels. If this changes we will update these Terms and, where required by law, seek your prior consent.
We implement industry-standard technical and organizational measures to protect your personal information, including encrypted transmission (TLS), hashed passwords (bcrypt), and access controls. No transmission over the internet is 100% secure; you use the Service at your own risk.
We retain personal data for as long as your account is active or as needed to provide the Service. The following specific retention periods apply:
After account deletion, we delete your personal data within 30 days except for transaction records retained for legal compliance, which are permanently deleted after 7 years.
GetOfferInsight and its licensors own all intellectual property rights in the Service, including the platform design, codebase, AI prompts, and branding. These Terms do not transfer any ownership interest to you.
Reports generated for your personal use are licensed to you for personal, non-commercial use only. You may not reproduce, redistribute, sell, or publicly display Report content without prior written consent from GetOfferInsight.
You retain ownership of content you provide (profile text, uploaded photos, uploaded documents). You grant GetOfferInsight a non-exclusive, worldwide, royalty-free license to use, host, store, and process that content solely to operate and improve the Service and to compile de-identified Market Insights as described in Section 10.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GETOFFERINSIGHT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, LOSS OF DATA, PERSONAL INJURY, OR PROPERTY DAMAGE ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL GETOFFERINSIGHT'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO GETOFFERINSIGHT IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion of implied warranties or the limitation of liability for consequential damages, so the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless GetOfferInsight and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third party's rights; or (d) any content you submit to the Service, including Agent profile content.
These Terms and any dispute arising out of your use of the Service are governed by the laws of the State of Oregon, United States, without regard to its conflict of law provisions.
Arbitration. Except for claims that qualify for small claims court, you and GetOfferInsight agree to resolve any dispute through binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules. The arbitration shall be conducted in Portland, Oregon, or by video conference. You and GetOfferInsight waive any right to a jury trial and to participate in a class action or class arbitration.
You have 30 days after first becoming aware of a dispute to opt out of arbitration by emailing legal@getofferinsight.com with the subject "Arbitration Opt Out." Opting out does not affect any other provision of these Terms.
We may update these Terms from time to time. When we make material changes, we will post the updated Terms on this page with a new effective date and notify active users by email at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
If we change the terms under which we share data with third parties in a way that is materially less favorable to you, we will request fresh consent before processing your data under the new terms.
